What is a Privacy Notice?

Air Charter Service is committed to comply with relevant privacy laws and regulations. This Privacy Notice describes how Air Charter Service processes the personal data we collect when you access or use our website or services. This will also provide information on how we work and protect your personal data.

The Controller

Air Charter Service are the controller responsible for processing your personal data, which will only be collected for specified, explicit and legitimate purposes, and not further processed in a manner that is incompatible with those purposes.

Air Charter Service’s data protection and privacy measures are governed by Kazakhstan Law Concerning Personal Data and Protection Thereof No. 94-V of  21 May 2013, Enhanced Partnership and Cooperation Agreement between the European Union and its Member States, on the one side, and the Republic of Kazakhstan, on the other side (Astana, 21 December 2015) and any national implementing laws, regulations and secondary legislation, and will be amended or updated in accordance with them from time to time.

What personal data will Air Charter Service collect about me?

When creating your profile, we will collect a variety of information, including, but not limited to; your first and last name, email address, telephone number, current employer, current job title, your area of interest and a copy of your most up to date personal profile (cv/resume).

Additionally, we may ask for job related personal data during the selection process. This will be information about your previous work experiences and salary expectation.

Depending on the country of interest the scope may vary. It is possible that sensitive information such as trade union membership or health information are questioned. This is dependent on the local requirements of the country where the specific job vacancy is. This information will be added to your profile.

How is my personal data collected?

Air Charter Service will collect and process your personal data to fulfil requirements relating to recruitment processes. Your explicit consent to process your personal information will be obtained through the recruitment system at point of submitting your application. Your explicit consent to process your personal information will also be obtained at point of onboarding should your application be successful.

You may directly provide your personal data to us, or we may collect your personal data from third parties, such as recruitment agencies; we may also collect information from publically available sources such as job boards and social media platforms.

How long will Air Charter Service keep my data?

When you create a profile, we will retain the personal data for a period of 24 months after your last login. You will be informed about the deletion of your profile via email. You may delete your profile at any time before the expiry of this period.

The period of personal data retention may extend the aforementioned period, if required by Kazakhstan law.

What is Air Charter Service’s basis for processing my personal data?

Air Charter Service collects and processes your Personal Data on the basis of different legal grounds, depending on the nature of the Personal Data being provided and the type of processing involved. 

Performance of a Contract

Some of the Personal Data is processed on the basis that it is necessary for the performance of our agreement with you, or in order to take steps at the request of the user prior to entering such an agreement. An example of this would be where Air Charter Service needs to verify your identity to further the job application.

Legitimate Interest

A ground relied upon for processing your Personal Data is legitimate interests, where we believe you have a reasonable expectation that we will perform a particular type of processing on your behalf, or where such processing is strictly necessary for fraud detection and prevention. An example would be where we respond to your queries and enquiries.

Consent

A ground relied upon in order to collect and process certain types of Personal or Sensitive information, or where appropriate to keep you informed of any similar job vacancies that may be of interest. Compliance with a Legal Obligation

A ground relied upon for certain types of processing is that it is necessary in order to allow compliance with a legal obligation. An example of this would be to retain business records for fixed periods of time in order to comply with local legal requirements.

Who will Air Charter Service share my personal data with?

Our service providers

This includes external third-party service providers, such as ‘Smart Recruiters’ who supply our recruitment system, professional advisors and IT support providers that assist us in carrying out business activities. 

Our group companies

We are a member company of Mountfitchet Group. We may share your personal data with certain members of our group companies, if so we will obtain your explicit consent. Air Charter Service will remain responsible for the management and security of jointly used Personal Information. Access to Personal Information within Air Charter Service, and our group of companies, is restricted to those individuals who have a need to access the information for our business purposes.

Personal data may be disclosed by Air Charter Service to the aforementioned parties by various means, including, but not limited to, cross-border transfer.

Is my personal secure?

Air Charter Service is committed to keeping your personal data safe and secure from unauthorised access to or unauthorised alterations, disclosure or destruction of information that we hold.

Our security measures include:

• encryption of our services and data;
• review our information collection, storage and processing practices, including physical security measures;
• access control restrictions for personal information;
• contractual confidentiality and processing agreements for employees and/or third parties who may require access to personal data; and
• internal policies setting out our data security procedures and training for employees.

What rights do I have in relation to my personal data?

Under certain circumstances, you have rights under Data Protection Legislation in relation to your personal data.

• Request access to your personal data;

• Demand correction and complementation of your personal data;

•  Request erasure of your personal data;

•  Object to processing of your personal data;

•  Request transfer of your personal data;

• Request restriction of processing your personal data;

• Right to withdraw consent;

• Demand blocking of personal data when aware of infringement of conditions for personal data collection and processing;

• Demand destruction of your personal data collected and processed in violation of Kazakhstan law.
